WAVE ENGLISH, a simplified joint-stock company with a sole shareholder, with share capital of €10,000, whose registered office is located at 10 rue de la Paix, 75002 Paris, registered with the Paris Trade and Companies Register under number 988 380 598 (hereinafter: the "Company"), has designed and publishes a website accessible in particular under the domain name "http://www.wave-english.com" (hereinafter the "Site"), and wishes to assure its members that their personal data is collected and used in a transparent, confidential, and secure manner, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation).

The Company's personal data protection policy describes how the personal data of visitors and members (hereinafter the "Members") is processed during their browsing of our Site. We invite you to read it carefully.

This policy also informs Members of the procedures for collecting and using their personal data and the options available to them in this regard. It is understood that this Policy forms an integral part of the General Terms and Conditions of Use of the Site. It applies to the Site as well as any variations thereof, on different media.

The Company pays constant attention to the data of its Members. Accordingly, the personal data protection policy may be modified, supplemented, or updated, in particular to comply with any regulatory, case-law, editorial and/or technical changes. We invite you to regularly consult, and before any navigation on the Site, the latest version in force of the Policy, accessible on our Site. If major changes are made, we will inform you by email or online to allow you to review these changes before they take effect.


Article 1: What personal data is collected?

Personal data is defined as "any information relating to an identified or identifiable natural person; an 'identifiable natural person' is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural, or social identity".

The personal data collected on the Site is:

  • your last name, first name, date of birth, email address, phone number, login ID, postal address, profession;
  • your location data, depending on the permissions of your mobile or computer operating system, based on GPS data, IP address, and Wi-Fi;
  • the information communicated as part of the message sent via the "contact" tab;
  • information about your use of the Site recorded via cookies or other trackers: your IP address, internet service provider, type of browser used, operating system, pages of the Site visited, date and time of access, as well as behavioural data relating to the analysis of actions and choices made on the Site.

It is specified that a Member is not required to provide personal data other than that necessary for connection to the Site and use of the Services.


Article 2: What are the purposes of collecting your personal data?

The purposes of the collection and processing of personal data by the Company are as follows:

  • Display of the Site and its Services
  • Creating and managing Members' accounts
  • Producing statistics on the consultation of articles and pages of the Site
  • Data analysis as part of the development of artificial intelligence algorithms intended to feed our intelligent and interactive data visualisation services
  • Improving your experience on the Site and the use of the Services
  • Sending informational and promotional emails about the Site and its Services
  • Anonymously producing statistics on Site activity to measure, in particular, the satisfaction and quality of the Services and thus enable the improvement and optimization of the Site
  • Managing the security of the Site


Article 3: Who processes and collects your personal data?

Your personal data is collected and processed by the Company when you connect to the Site and when using the Services. Under certain conditions, this data is also shared with subcontractors and contractual partners (third parties).

The Company collects your personal data as defined in Article 1 for the purposes described in Article 2.

The Company will only proceed with this collection if it obtains your informed consent to process your personal data. Otherwise, the Company will not use this personal data for the above purposes. It is however specified that a lack of consent from a Member may lead to limited use of the Site and its Services.

With your consent, the Company may aggregate personal data concerning you, in particular all or part of your personal data and information collected through cookies. This aggregated information will only be used for the purposes described above.

3.2 Third parties

3.2.1 The Company's third-party partners

The personal data concerning you collected on the Site is intended for use by the Company.

The Company may only communicate the data necessary for processing your requests and/or its services to its contractual partners involved in the execution thereof (in particular to intermediaries for the payment of subscriptions).

The Company only transmits your personal data to third parties:

  • when the Company must share said information with its service providers to provide the services you have requested; and
  • when the Company receives a request from a judicial authority or any administrative authority authorised by law, seeking the communication of this information in accordance with the legislative provisions in force, under the conditions of Article 3.2.2 hereof.

These third-party partners are responsible for processing your personal data once your consent for processing has been communicated to them. It is therefore up to them to comply with the law in force (and in particular with the GDPR) as well as to take into account your requests and rights.

3.2.2 Third parties authorized by law

Your personal data may be transmitted when the Company is required to do so, in particular in the cases described below.

  • To respond to any claim against the Company
  • To comply with any judicial request, to enforce any contract entered into with our Members, such as the General Terms and this personal data protection policy
  • In an emergency involving public health or the physical integrity of a person
  • As part of inquiries and investigations carried out by a public authority
  • To guarantee the rights, property and security of the Company, its members and more generally any third party
  • If the Company is compelled to do so by a governmental authority or regulatory body, in the event of a judicial requisition, subpoena, or any other similar governmental or judicial requirement, or to establish or defend a legal claim
  • To your Internet service provider in the event of a legitimate request
  • To a third party issuing a cookie stored on your terminal


Article 4: Is your personal data transferred outside the European Union?

We transfer and store your personal data in the European Union. Upon simple request, we can provide you with the list of countries where we store your data and those where it occasionally transits.


Article 5: How is your personal data protected?

The Company applies the technological and organisational security measures generally recognised so that the personal data collected is neither lost, misappropriated, accessed, modified nor disclosed by unauthorised third parties, unless its communication is required by the regulations in force, in particular at the request of a judicial authority or any other authority authorised by law.

The security of personal data also depends on the Members. Members undertake to maintain the confidentiality of their login and password. Members also undertake not to share their account and to notify the Company of any unauthorised use of said account as soon as they become aware of it.


Article 6: How long is your personal data retained?

The personal data communicated by Members of the Site is retained only for the time necessary to carry out the purposes pursued in accordance with legal requirements.

At the end of this period, and at the latest after a period of 2 years from the termination of the Member's account, your personal data is deleted by the Company.

However, to allow Members to recover their account in the event of forgetting their password after a prolonged period without connection to the Site, your email address is retained for security purposes.

Certain data may be retained (invoices, credit notes) for a commercially reasonable period, for backup, archiving, or auditing purposes. The mandatory retention period is in particular ten (10) years for invoices.


Article 7: Are you a minor?

Our objective being to make English accessible to everyone, minors may access the Site to read articles and learn the language.

Before accessing the Site, the consent of minors under 16 must be given by the holder of parental authority. You must read this personal data protection policy with your parents or legal representative to ensure that you, and your parents or legal representative, understand it.

You may request that personal data concerning you be deleted from our databases in accordance with Articles 8 and 9 of this data protection policy.


Article 8: What are the rights of Members?

In accordance with the regulations in force, Members of the Site have the following rights:

  • Right of access to their personal data
  • Right of rectification of their personal data
  • Right to update their personal data
  • Right to block or delete personal data, when it is inaccurate, incomplete, equivocal, outdated, or whose collection, use, communication, or retention is prohibited
  • Right to withdraw consent at any time
  • Right to limit the processing of personal data
  • Right to object to the processing of personal data
  • Right to the portability of personal data that Members have provided, when such data is subject to automated processing based on their consent or a contract.

To submit a request concerning one of the rights listed above, Members must follow the procedure set out in Article 9 hereof.

In the event of deletion of your personal data, it is understood that one consequence may be the inability to access the Services offered by the Site.

For promotional emails, you may at any time withdraw your consent by clicking on the unsubscribe link provided in each of our communications or by contacting us.


Article 9: How to contact the Company about your personal data?

Your requests will be processed within 30 days. In addition to your request, we will ask you to attach a photocopy of proof of identity so that the Company can verify your identity. You also have the right to lodge a complaint with a personal data protection supervisory authority. The French authority is the CNIL (Commission Nationale de l'Informatique et des Libertés).

Article 10: How does the Company use cookies on its Site?

Depending on your cookie settings, you accept that the Site stores information concerning your browsing, in particular to ensure the proper functioning of the Site, to establish traffic statistics and to optimize its conditions of use and the services offered therein.

10.1 Definition of the term cookie

A cookie is a small text file placed on your hard drive.
