WAVE ENGLISH, société par actions simplifiée à associé unique, au capital social de 10 000 euros, dont le siège social est situé au 10 rue de la Paix, 75002 Paris, immatriculée au registre du commerce et des sociétés de Paris sous le numéro 988 380 598 (ci-après : la »L'entreprise«), a conçu et édite un site internet accessible notamment sous le nom de domaine »http://www.wave-english.com« (ci-après le »Site«), et tient à assurer à ses membres que leurs données personnelles sont collectées et utilisées de manière transparente, confidentielle et sécurisée, conformément au règlement (UE) 2016/679 (règlement général sur la protection des données).

La politique de protection des données personnelles de la Société décrit la manière dont les données personnelles des visiteurs et des membres (ci-après les « Membres ») sont traitées lors de leur navigation sur notre Site. Nous vous invitons à le lire attentivement.

Cette politique informe également les Membres des procédures de collecte et d'utilisation de leurs données personnelles et des options qui s'offrent à eux à cet égard. Article 1 : Quelles sont les données personnelles collectées ?

Les données personnelles sont définies comme »toute information relative à une personne physique identifiée ou identifiable ; une « personne physique identifiable » est une personne physique qui peut être identifiée, directement ou indirectement, notamment par référence à un identifiant, tel qu'un nom, un numéro d'identification, des données de localisation, un identifiant en ligne, ou à un ou plusieurs facteurs spécifiques à son identité physique, physiologique, génétique, mentale, économique, culturelle ou sociale«.

Les données personnelles collectées sur le Site sont les suivantes :

  • vos nom, prénom, date de naissance, adresse e-mail, numéro de téléphone, identifiant de connexion, adresse postale, profession ;
  • vos données de localisation, en fonction des autorisations du système d'exploitation de votre mobile ou de votre ordinateur, sur la base des données GPS, de l'adresse IP et du Wi-Fi ;
  • les informations communiquées dans le cadre du message envoyé via le »contacter« onglet » ;
  • des informations relatives à votre utilisation du Site enregistrées via des cookies ou autres traceurs : votre adresse IP, votre fournisseur d'accès à Internet, le type de navigateur utilisé, le système d'exploitation, les pages du Site visitées, la date et l'heure d'accès, ainsi que des données comportementales relatives à l'analyse des actions et des choix effectués sur le Site.

Il est précisé qu'un Membre n'est pas tenu de fournir d'autres données personnelles que celles nécessaires à la connexion au Site et à l'utilisation des Services.


Article 2 : Quelles sont les finalités de la collecte de vos données personnelles ?

Les finalités de la collecte et du traitement des données personnelles par la Société sont les suivantes :

  • Affichage du Site et de ses Services
  • Création et gestion des comptes des membres
  • Produire des statistiques sur la consultation des articles et des pages du Site
  • Analyse des données dans le cadre du développement d'algorithmes d'intelligence artificielle destinés à alimenter nos services de visualisation de données intelligents et interactifs

Article 3 : Qui traite et collecte vos données personnelles ?

Vos données personnelles sont collectées et traitées par la Société lorsque vous vous connectez au Site et lorsque vous utilisez les Services. Sous certaines conditions, ces données sont également partagées avec des sous-traitants et des partenaires contractuels (tiers).

These third-party partners are responsible for processing your personal data once your consent for processing has been communicated to them. It is therefore up to them to comply with the law in force (and in particular with the GDPR) as well as to take into account your requests and rights.

3.2.2 Third parties authorized by law

Your personal data may be transmitted when the Company is required to do so, in particular in the cases described below.

  • To respond to any claim against the Company
  • To comply with any judicial request, to enforce any contract entered into with our Members, such as the General Terms and this personal data protection policy
  • In an emergency involving public health or the physical integrity of a person
  • As part of inquiries and investigations carried out by a public authority
  • To guarantee the rights, property and security of the Company, its members and more generally any third party
  • If the Company is compelled to do so by a governmental authority or regulatory body, in the event of a judicial requisition, subpoena, or any other similar governmental or judicial requirement, or to establish or defend a legal claim
  • To your Internet service provider in the event of a legitimate request
  • To a third party issuing a cookie stored on your terminal


Article 4: Is your personal data transferred outside the European Union?

We transfer and store your personal data in the European Union. Upon simple request, we can provide you with the list of countries where we store your data and those where it occasionally transits.


Article 5: How is your personal data protected?

The Company applies the technological and organisational security measures generally recognised so that the personal data collected is neither lost, misappropriated, accessed, modified nor disclosed by unauthorised third parties, unless its communication is required by the regulations in force, in particular at the request of a judicial authority or any other authority authorised by law.

The security of personal data also depends on the Members. Members undertake to maintain the confidentiality of their login and password. Members also undertake not to share their account and to notify the Company of any unauthorised use of said account as soon as they become aware of it.


Article 6: How long is your personal data retained?

The personal data communicated by Members of the Site is retained only for the time necessary to carry out the purposes pursued in accordance with legal requirements.

At the end of this period, and at the latest after a period of 2 years from the termination of the Member's account, your personal data is deleted by the Company.

However, to allow Members to recover their account in the event of forgetting their password after a prolonged period without connection to the Site, your email address is retained for security purposes.

Certain data may be retained (invoices, credit notes) for a commercially reasonable period, for backup, archiving, or auditing purposes. The mandatory retention period is in particular ten (10) years for invoices.


Article 7: Are you a minor?

Our objective being to make English accessible to everyone, minors may access the Site to read articles and learn the language.

Before accessing the Site, the consent of minors under 16 must be given by the holder of parental authority. You must read this personal data protection policy with your parents or legal representative to ensure that you, and your parents or legal representative, understand it.

You may request that personal data concerning you be deleted from our databases in accordance with Articles 8 and 9 of this data protection policy.


Article 8: What are the rights of Members?

In accordance with the regulations in force, Members of the Site have the following rights:

  • Right to the portability of personal data that Members have provided, when such data is subject to automated processing based on their consent or a contract.

To submit a request concerning one of the rights listed above, Members must follow the procedure set out in Article 9 hereof.

In the event of deletion of your personal data, it is understood that one consequence may be the inability to access the Services offered by the Site.

Your requests will be processed within 30 days. In addition to your request, we will ask you to attach a photocopy of proof of identity so that the Company can verify your identity. You also have the right to lodge a complaint with a personal data protection supervisory authority. The French authority is the CNIL (Commission Nationale de l'Informatique et des Libertés).

Article 10: How does the Company use cookies on its Site?

Depending on your cookie settings, you accept that the Site stores information concerning your browsing, in particular to ensure the proper functioning of the Site, to establish traffic statistics and to optimize its conditions of use and the services offered therein.
